Later that afternoon a young boy came running into the office. "You gotta help my dad. Jessie Cole and his men are tryin' to take over our claim."
He had brought an extra horse and we rode with him out to the mine. He told us that he was Jim Endicott and that Will was his father. When we arrived, Cole's men were staging a gun battle with Endicott who was holed up in the mine shack with pistols and a shotgun. I told Cole to hold his fire and gave him time to show me the signed paper giving ownership of the mine to him. He said, "He's on my land and won't give it up."
I said, "I am the sheriff. It is my job to evict him. I'll go in and talk to him. Tell your men to put down their guns." I walked up to the entrance with my hands raised. "This is Sheriff Wutherington. You know I don't carry a gun. Cole is staying out here. I'm comin' in to talk to you."
